Purchases and Payment Policy
Accepted Payment Methods

We accept secure payments through PayPal, Stripe, and all major credit or debit cards. All transactions are processed via encrypted third-party payment processors. The Painted Pose does not collect or store your full payment information at any time.

Deposits and Final Payments

 A non-refundable deposit is required to reserve bookings for paint parties, art commissions, or special events. The deposit secures your date and applies toward the total cost. Final payment is due on or before the date stated in your confirmation or invoice. Failure to pay the remaining balance on time may result in cancellation of the service or event, with forfeiture of the deposit.

Digital Products and Downloads

 All digital purchases—including templates, instructional materials, PDF downloads, or pre-recorded video access—are final and non-refundable once delivered. Please confirm you have the appropriate device, software, or internet access to use the files. We are happy to provide limited tech support within reason to help you access your materials.

Commercial Use Licensing

Unless otherwise noted, all downloads, designs, and creative resources are intended for personal use only. If you would like to use any of our artwork, templates, or instructional guides for business or commercial purposes (such as resale, workshops, or product development), please contact us to request a commercial use license. Unauthorized duplication, reproduction, or distribution of our work for commercial gain is strictly prohibited.

Special Payment Arrangements for Organizations

We proudly serve businesses, nonprofit organizations, and government agencies. Custom payment schedules or purchase order arrangements may be accommodated and will be clearly outlined in your signed proposal or service agreement. All terms must be agreed to in writing prior to the event or service delivery.

Sales Tax

Where applicable, sales tax will be calculated and added during checkout for physical goods. Tax exemptions for organizations must be requested in advance and accompanied by proper documentation.

Order Confirmation

 Once you place an order or submit a booking request, you will receive a confirmation email with important details. Please review it carefully to ensure accuracy. If you do not receive your confirmation within 24 hours, please contact us at support@thepaintedpose.com so we can verify your order status.

Product & Shipping Policies
Product Descriptions and Materials

We take great care in accurately describing each product, including images, supply lists, and kit contents. Paint Pops™ and other art kits may vary slightly due to seasonal availability or supplier changes. Any substitutions will be of equal or greater value, chosen with your creative experience in mind.

Pre-Sketched Canvases and Paint Kits

Each Paint Pop (Art Kit) includes pre-sketched 8" x 10" or 11" x 14" canvases, paint brushes, craft acrylic paints, and detailed written instructions. Our kits are designed for beginner-level painters and may include optional tips for more experienced artists. Unless you are ordering Canvas Only options.

Shipping Methods and Carriers

All physical orders are shipped using reliable carriers such as USPS or UPS. Shipping costs, timelines, and available delivery options are clearly stated at checkout. Tracking numbers will be provided by email once your order has shipped.

Shipping Timeline

 Standard orders typically ship within 3–7 business days. Custom or group orders may require additional processing time. Rush shipping may be available upon request, depending on stock and event deadlines.

Shipping Restrictions

We currently ship to addresses within the United States. If you require special arrangements (such as shipping to an event location, or multiple address deliveries), please contact us before placing your order.

Lost or Delayed Packages

Once a package is accepted by the carrier, delivery is out of our hands. If your package is delayed, marked as delivered but not received, or appears lost, please contact the shipping carrier directly first. We’re happy to assist in filing a claim if necessary.

Defective or Damaged Items

Check your order immediately upon delivery. If your order arrives with missing, damaged, or defective items, please notify us immediately upon arrival (within 2 business days of delivery). Photo documentation is required for replacements. We’ll work quickly to make it right.

Returns and Exchanges (Physical Products Only)

Returns are accepted on unopened, unused physical products within 14 days of delivery. To qualify, items must be in their original condition and packaging. Return shipping costs are the responsibility of the customer unless the return is due to our error. Once received and inspected, approved returns will be refunded (excluding original shipping).

Non-Returnable Items
The following items are not eligible for return or refund:

  • Digital downloads or templates

  • Custom or personalized art pieces

  • Opened or used art kits or paint supplies

  • Event tickets or private booking deposits

Group or Bulk Orders

For group events or large kit orders, we recommend placing orders 3–4 weeks in advance to allow for shipping, customization, and event prep. If you have a tight turnaround or special event needs, contact us—we’ll do our best to accommodate!

Event & Class Policies
Event Registration & Ticket Policy

All tickets for paint parties, pop-up events, and creative sessions are final sale and non-refundable. Once your spot is reserved, we immediately begin preparing materials and securing your event space.


However, we understand that life can be unpredictable. If you notify us at least 72 hours in advance, we’ll happily issue a one-time credit for the full value of your ticket—valid toward any upcoming event within the next 3 months, subject to availability.

Client Cancellations

  • More than 7 days before the event: Your deposit is non-refundable but may be applied to a rescheduled event date once, with no penalty.

  • Within 7 days of the event: Deposits and payments are non-refundable and no credit is issued, as supplies and logistics have already been committed.

No-Show Policy

If you or your guests fail to attend without prior notice, this will be treated as a no-show. Unfortunately, we cannot offer refunds or credits for no-shows.

Rescheduling Requests

We allow one-time reschedules per booking if requested at least 72 hours before your scheduled event.

  • For rescheduling requests made less than 72 hours in advance, a small rescheduling fee may apply.

  • Any additional changes after the first reschedule may result in a forfeiture of the deposit.

Materials & Kit Protection

In the case of short-notice cancellations, we may offer to ship your prepped materials to you as a courtesy so you can still enjoy a creative experience from home. Additional shipping costs may apply.

Cancellations by The Painted Pose

If we must cancel due to unforeseen circumstances (weather, illness, venue issues, etc.), you will receive:
✔ A full refund, or
✔ The option to reschedule at no additional cost

We value your time and will provide as much notice as possible in the event of cancellation on our end.

Weather, Safety & Conduct Clause

 In the rare event of unsafe conditions—such as severe weather, disruptive guest behavior, or venue-related safety concerns—The Painted Pose reserves the right to pause or cancel the event immediately.

  • No liability will be assumed for event interruptions caused by these conditions.
     

  • Rescheduling or refunds under these circumstances will be handled at our discretion, prioritizing safety and fairness.

Weather, Safety & Conduct Clause

Age & Alcohol Responsibility

Paint Parties hosted by The Painted Pose are open to all ages unless otherwise stated. Guests under 18 years old must be accompanied by a responsible adult.

Events that include alcohol (such as sip-and-paint parties) are restricted to participants 21 years or older, in accordance with state and local laws. Identification may be required by the host venue.

Alcohol Use & Guest Conduct

 For events where alcohol is present, guests are expected to consume responsibly and maintain appropriate behavior throughout the session.

  • We reserve the right to ask the host to intervene or remove any guest who is visibly intoxicated, disruptive, or acting inappropriately.
     

  • If any instructor or representative of The Painted Pose determines the event environment to be unsafe, inappropriate, or hostile, we reserve the right to stop or leave the event immediately.
     

  • No refunds or credits will be issued if an event is interrupted or terminated due to guest misconduct or alcohol-related issues.

Liability Waiver & Host Responsibility

By booking or attending a Paint Party with The Painted Pose, all participants and hosts agree to the following:

  • The Painted Pose and its instructors, volunteers, and contracted artists are not liable for any injuries, accidents, property damage, or behavior resulting from alcohol consumption or unsafe conduct by attendees or hosts.
     

  • The event host is fully responsible for the behavior and actions of their guests.
     

  • Hosts are expected to provide a safe, respectful, and stable environment for the instructor and all participants.
     

  • Payment is non-refundable and may be forfeited if the event is canceled early or disrupted due to intoxicated guests, harassment, safety violations, or other inappropriate behavior.
     

We are committed to providing joyful, creative experiences—and we believe that safety, respect, and accountability are essential to making that possible for everyone involved.

Membership & Subscription Terms

At The Painted Pose, we believe creativity should be joyful, restorative, and accessible to all. We offer (or are currently developing) subscription-based memberships, digital content bundles, and hybrid programs that give members exclusive access to inspiring art experiences, downloadable resources, and ready-to-use materials for personal or group use.

These offerings are thoughtfully designed to support:

  • Employee, student, and community wellness through relaxing, low-pressure creative experiences that promote emotional balance and reduce stress
     

  • Team and group engagement through shared creative activities that build connection, communication, and morale
     

  • Educational enrichment and family involvement by providing accessible, art-based content that aligns with social-emotional learning and wellness goals

The Paint Party Directory – Coming April–May 2025

The Paint Party Directory - currently in development - a public platform for Paint Party Business Owners and Creative Entrepreneurs who offer variations of social painting experiences. This platform is designed to increase visibility, build community, and elevate the paint party industry.

Details on listings, subscription tiers, and promotional opportunities will be rolled out in April and May 2025. Access may be limited based on region, category, or tier during initial enrollment phases.

Our signature membership program, The Canvas Club, is currently in development with three options to serve a variety of creative needs:

  • Online Only Membership – Access to exclusive live-stream classes, downloadable templates, creative challenges, and virtual paint parties.

  • Canvas Only Membership – Receive a pre-sketched monthly canvas with painting instructions shipped to your door.

  • Hybrid Membership – A combination of digital access and physical product delivery, perfect for those who enjoy both convenience and hands-on materials.
     

Depending on timing, enrollment access may be limited or seasonal, with priority given to those on the waitlist. We encourage interested members to subscribe for email updates and join our waitlist for first notification when enrollment opens.

There are no trial offers, but there may be special introductory promotions for Founding Members, early bird sign-ups, or annual commitments that include bonus content, exclusive kits, or discounted rates.

Corporate & Organizational Memberships

We are also developing customizable art-based subscription options for organizations seeking engaging, wellness-driven creative experiences for their members, staff, or communities. These may include:

Membership Access & Billing
  • Access to membership content is granted only while the membership is active and in good standing.

  • Memberships may be billed monthly or annually, with the option to auto-renew.

  • Payment is required at the beginning of each billing cycle. You may cancel anytime before your renewal date to avoid future charges.

Cancellation & Refund Policy
  • Memberships can be canceled at any time. Cancellation will take effect at the end of the current billing cycle.

  • No partial refunds will be issued for unused time.

  • If your membership includes physical product delivery (e.g., monthly Paint Pops™), cancellation must be made prior to the shipment cutoff date (e.g., the 10th of the month) to avoid being charged for the next shipment.

Failed Payments
  • If a recurring payment fails, we will retry your payment method for a limited time before suspending access.

  • Members will be notified by email with instructions to update payment details.

Art Commission Terms

Custom artwork is a beautiful and meaningful way to capture a person, memory, or moment. At The Painted Pose, we offer commissioned pieces created with care, intention, and artistic excellence. The Painted Pose offers original hand-painted portraits and digital artwork commissions, as well as downloadable art products. 

 

Whether you are commissioning a personal or corporate portrait, requesting a one-of-a-kind piece, a legacy piece, artwork for an organization or special event, or purchasing a ready-to-use creative download, we strive to protect the integrity of our work and the experience of our clients through respectful, clear, and fair terms. These terms ensure clear communication and expectations.

🎨 Hand-Painted Portraits & Custom Artwork

All traditional commissions begin with a consultation and formal quote. A non-refundable deposit (typically 50%) is required to begin, and no work will begin until terms are agreed upon and the contract or email confirmation is signed and received.

Each project will include details regarding the subject, size, medium, and timeline. Clients receive the original artwork upon final payment. Framing and shipping costs, if applicable, will be stated in advance.

  • The Painted Pose reserves the right to decline commissions that fall outside our artistic focus or timeline availability.

Revisions & Approval Process
  • Clients will receive a preliminary sketch or progress image (digital photo) for review and feedback.

  • Up to two minor revisions are included in the commission price. Additional revisions may incur a fee, depending on complexity.

  • Once the final artwork is approved and payment is completed, no further changes will be made.

Timeline & Delivery
  • Turnaround time varies depending on the scope of the project, materials used, and the artist’s queue. A typical timeline will be stated upfront and confirmed at the time of deposit.

  • Rush orders may be accommodated for an additional fee and must be agreed upon in writing.

  • Completed artwork will be delivered digitally or physically, depending on the terms of your agreement. Shipping costs may apply and will be clearly stated.

Ownership & Copyright
  • The client receives ownership of the physical artwork (or digital file, if applicable) once the final payment is received.

  • The Painted Pose retains all reproduction rights, including the right to photograph, display, or include the artwork in future portfolios or marketing, unless otherwise negotiated in writing.

  • Commercial use, duplication, or resale of the artwork requires a separate commercial licensing agreement.

Cancellations & Refunds
  • If a client cancels before the artwork is completed, the non-refundable deposit will be retained, and no further charges will apply.

  • If a cancellation is made after the final piece has been completed, no refund will be issued.

  • In rare cases where the artist must cancel a project, a full refund will be provided, including the deposit.

💻 Digital Custom Artwork

Digital commissions include high-resolution artwork delivered via email or private download link. These may include portraits, keepsakes, or commemorative illustrations. Digital commissions also require a non-refundable deposit and are subject to the same terms as physical work.

Clients receive personal-use rights unless a commercial license has been explicitly granted.

Our downloadable art templates, guides, and designs are sold for either Personal Use or Commercial Use—as indicated in each individual product description.

Personal Use Terms

Personal Use licenses allow the buyer to:

  • Download and print the artwork for individual or household enjoyment
     

  • Share with household members (typically 2–6 people) for a family paint night or personal project
     

  • Gift the finished painting, hang it at home, or enjoy it as a creative hobby
     

However, personal use does not grant rights to:

  • Reprint or redistribute the artwork for others
     

  • Host group paint parties, classes, or events using a single download
     

  • Post the design as your own or claim authorship
     

  • Sell, resell, or publish the artwork in any format
     

  • Use the artwork within online memberships, print-on-demand platforms, or digital courses
     

Creating from a personal-use design and reselling the finished painting—physically or digitally—as your own original work is expressly prohibited.

🏢 Classroom & Group Use Licensing

If you are a teacher, program director, senior center, homeschool group, nonprofit, or business, and wish to use our products for an event, class, or group experience, we kindly ask that you contact us for appropriate licensing.

We offer affordable and flexible licensing agreements on a case-by-case basis for:

  • School or district-wide use
     

  • Parks and recreation or community centers
     

  • Art therapists and enrichment providers
     

  • Team-building events or corporate wellness initiatives
     

  • Organizations using our work within a membership or recurring program
     

These licenses are designed to honor both the value of original art and the mission of those serving their communities through creativity.

  • You may not copy, alter, or redistribute the design without express written permission
     

  • Unauthorized resale, repurposing, or reproduction of any product—physical or digital—is a violation of these terms and subject to enforcement

Photography, Video & User-Generated Content

The Painted Pose celebrates creativity and community—and we love to showcase the joyful moments our customers, guests, and artists experience together. We may capture photos or video footage during live events, or collect content voluntarily shared by our audience online.

To maintain transparency and respect for your privacy, the following policies apply to any photos, videos, or creative content shared with or captured by The Painted Pose:

📸 Photography & Video at Events
  • By attending a public event hosted by The Painted Pose, you acknowledge that photos or short video clips may be taken and used for marketing, documentation, or social media promotion.
     

  • This may include images of the event setup, artwork in progress, and group moments.
     

  • We focus on capturing the overall experience—not close-up portraits—unless you have given express verbal or written consent.
     

Private or Corporate Events:

  • For privately booked events, we may request permission to take photos for use in our portfolio or social channels. Hosts will always be asked in advance and may decline.
     

  • If a guest prefers not to be included in any photos or video, they may simply notify the instructor at the event, and we will fully respect that request.
     

🧑‍🎨 User-Generated Content (UGC)
  • We often feature photos, testimonials, and tagged posts shared by our amazing customers. When you tag us, email us, or use a branded hashtag (such as #thepaintedpose or #paintwithpose), you are granting us permission to:

  • Repost or share your image or quote on our website, email newsletter, or social media channels
     

  • Credit you as the creator or participant whenever possible
     

  • Crop, resize, or lightly edit the image for layout or design purposes, without altering its intent or meaning

 

If you would prefer not to have your content shared, please let us know at any time by emailing support@thepaintedpose.com, and we will remove it promptly.

🔒 Opt-Out Procedure
  • We want you to feel confident and safe in how your image or content is used. To opt out of photography, filming, or social media usage:

  • Verbally notify your event instructor or host
     

  • Or contact us before or after the event via our Contact Page or at support@thepaintedpose.com
     

  • We will honor your wishes without question.

🤳 Tips for Hosts & Event Planners
  • If you're booking a private event, you may let your guests know ahead of time that photos may be taken (especially if you'd like to feature it on your organization's website or newsletter).
     

  • We’re happy to provide a folder of highlights after the event for hosts to use or share—just let us know!

While we take every reasonable step to ensure a safe and positive environment, certain legal disclaimers and protections must be outlined below to clarify responsibility and uphold mutual respect between our business and our clients.

⚖️ General Liability Disclaimer

By participating in an event, purchasing products, or engaging with our services, you acknowledge and accept that:

  • Participation in creative activities such as painting may involve the use of water, paints, and other materials that could stain clothing or surfaces.
     

  • The Painted Pose is not responsible for personal injury, allergic reactions, damage to personal property, or venue-related issues that may occur during an event or through product usage.
